Coup leader calls for Immigration to relax ‘out-in’ visa clampdown.

Thailand’s coup leader and prime minister-in-waiting, Gen Prayuth Chan-Ocha last night (August 22) called for the Immigration crackdown on “out-in” tourist visas to be rolled back.

During his weekly TV briefing to the nation, aired on all channels, the general said he had ordered the Immigration Police to be “more flexible” in its application of the law.

Immigration recently cracked down on the number of times a foreigner may cross the border into a neighboring country, turn around and re-enter the country on a new tourist visa.

Many of the people doing multiple out-in tourist visas were believed to be working in the country illegally, often as teachers or tour guides.

According to the English subtitles of his speech, the general said he was concerned that the clampdown – whereby people doing out-in visas are required to prove they are genuine tourists, or be barred from entry – was affecting schools and the tourist industry.

“This is an ongoing problem that needs to be resolved, as it can lead to a shortage of English teachers and guides,” he said.

The statement will shock many in the bureaucracy, on several levels. First, it is illegal to work while in Thailand on a tourist visa. Second, people working illegally pay no tax. And third, foreigners may not be guides in Thailand; that is a profession reserved for Thais only.

The crackdown was launched by the then-national commander of Thai Immigration, Lt Gen Pharnu Kerdlarpphon, who told The Phuket News on May 13, just nine days before the coup, that multiple out-in visa runs would no longer be tolerated. He has since been sidelined.

The question of foreigners working as tour guides has long been a troubled one. Although Thais alone may be tour guides, there are very few Thai guides who speak, for example, Korean or Russian, for which there is great demand. This fuels the number of people working illegally.

Even if Immigration now turn a blind eye to out-in visa runners, it will not solve the problems of unqualified foreigners teaching languages or foreign guides knowing nothing about the island’s history and making it up as they go along, leaving the tourists they instruct with a twisted understanding of Thai culture and history.

Thousands of foreigners in Phuket will be watching this issue with great interest.

New Rules Destroy Tourism in Bangkok

Street resistance: Vendors say new sidewalk rules hurt business

Contrary to official reports, vendors are resisting orders to clear the streets and make way for pedestrians.

On a field trip with a city official to check out street stalls between sois Ramkhamhaeng 17 and 65, members of the media saw many not complying with orders to operate only at night.

Intended as a dog-and-pony show to show the success of the new street rules, the tour found a small portion street vendors have followed the new rules. Only 30 of 207, admitted tour leader Wanlop Suwandee, chief adviser to the Bangkok governor’s office.

Visits were also made to stretches of Sukhumvit Road and areas in Khlong Toey and Watthana districts, where Wanlop claimed more vendors are following the request to only operate from 7pm to midnight.
Some vendors, such as one near Soi Nana, told the Bangkok Post, she’s been there for over 20 years, and although she was willing to comply with the rules, said it would ruin her business as most evening visitors in the area were not there for shopping.

She said she’ll petition junta officials for help should the policy negatively affect her business.

No need to worry says #Bangkok Immigration Commander.

He confirmed that foreign tourists and expats do not need to carry their passports with them at all times.

He said that tourists can of course leave their passports locked in their hotel safe and enjoy their holiday in Thailand without worrying about the need to carry their original passport.

Deputy Commander Voravat also said that for expats living here, a Thai driving license or photocopy of your passport can be used as a form of identification.

However, if Immigration Police suspect an individual to be overstaying in Thailand or being involved in illegal activity, then the individual would be required to produce their original passport promptly.

Deputy Commander Voravat referred to Section 58, which reads as follows:

Any alien who has no lawful document for entering the Kingdom under section 12(1);….under this Act; and has no identification in accordance with the Law on Alien registration, is considered to have entered the Kingdom in violation of the Act.

Entering or staying in Thailand without holding a valid passport and visa/extension is subject a fine and possible prison sentence.

“Making all foreigners in Thailand carry their original passports with them would be very difficult.”
“It’s about being reasonable and using common sense”

“But if we think a foreigner is involved in illegal activity then we will of course need to see their original passport, this is normal”, said Deputy Commander Voravat.

Deputy Commander Voravat is eager to avoid further misunderstandings and miscommunication regarding immigration matters and is happy to work with Thaivisa.com in the future in order to provide correct information to foreign tourists and the wider expat community in Thailand.

Thaivisa.com thanks  Deputy Commander Voravat for his interview and taking time to clarify the situation.

The idea of foreigners being able to get a copy of their passport officially stamped by Immigration is currently not an option. However, it is always a good idea to have a copy of your passport with you at all times while in Thailand.

Immigration clarifies rules on foreigners carrying ID

Aliens must now carry valid ID at all times, report within 24 hours

Following yesterday’s news regarding the requirement for foreigners in Thailand to carry ID with them at all times, Thaivisa.com and local Immigration offices have been inundated with messages and comments from foreigners concerned about how they may be affected by this news.
In order to seek fruther clarification about this, Thaivisa.com has today met with Pol.Col. Thanasak Vongluekiat, Superintendent of Prachuap Khirikhan and Phetchaburi Immigration.

Pol.Col. Thanasak confirmed the following:

1. By law, all tourists and expats nationwide are required to carry their original passports with them at all times. There is no exception to this. Failure to carry your original passport may result in a 2,000 THB fine. The reason behind this is that Immigration needs to keep track of overstayers and foreign criminals who may be staying illegally in the country.

2. The information provided at an Immigration meeting yesterday was unclear. The correct information, which has always been the case, is that no other forms of identification are acceptable. This includes any other form of photo ID, such as a Thai/foreign driving license or a photocopy of your passport.

3. Immigration does not provide any kind of ‘stamp’ verification on a photocopy of a passport as announced at the meeting yesterday. Therefore, you are required to keep your original passport with you at all times as per point #1 above.

Thaivisa.com would like to thank Pol.Col. Thanasak Vongluekiat and his staff for taking time out of their busy schedule in order to clarify this.

--------------------------------------------------------------------------------------

Hua Hin Immigration is from today enforcing the existing rule that foreigners are required to carry a valid photo ID at all times.

At a meeting with Hua Hin Immigration and municipality, Thaivisa.com was informed of the news about the immediate enforcement regarding the requirements for foreigners - both tourists and expats - to carry valid photo ID at all times. Thaivisa has learned that Immigration is likely to enforce this nationwide.

Valid ID's are:

- Thai Drivers License
- Passport original
- Copy of passport verified and stamped by Hua Hin Immigration

Penalty:
Failure to carry valid ID as above is 2,000 Baht.

24-hour reporting

Hua Hin Immigration is from today also enforcing the requirements that you and your landlord (condominium owner, house owner etc) must report to Immigration within 24 hours of moving in to a new address. On your arrival card you already reported your place of stay, and if that changes you need to visit Immigration and report your new address. This applies to both tourists and expats.

Here are the two Immigration forms to be used, they can be downloaded from Thaivisa here:

Here is the TM28 form that must be used from now in Hua Hin, and nationwide if/when enforced:

There is also another reporting obligation, and this applies when a foreigner visits another province and stays for more than 48 hours. In that case the reporting of the new address must be provided to the police, or the immigration, within 48 hours.

Here is the form to be used by house master or owner or possessor of the residence where foreigners reside:
